Who deducts Professional Tax in Tamil Nadu?

The contractor, as the employer that pays wages, twice a year. In Chennai most full-time workers owe ₹1,250 a half-year. Slabs, dates and who checks.

In Tamil Nadu, Professional Tax is a local-body tax charged twice a year, and the employer who pays the wages deducts it. For contract labour that is the contractor, not the site. In Chennai, a worker whose half-yearly earnings top ₹75,000, roughly ₹12,500 a month, pays ₹1,250 for each half-year, under the Greater Chennai Corporation's notice of 6 March 2025. Anyone employed on a casual basis is outside the tax.

Who pays it, and who deducts it

The worker owes the tax; the employer who disburses the wages deducts it and is liable for it either way. In a city or town it is levied under Chapter VI-A of the Tamil Nadu Urban Local Bodies Act 1998, as amended in 2022: section 117-B levies the tax and section 117-C makes the employer deduct it and pay it on the employee's behalf (Greater Chennai Corporation notice, 6 March 2025). In a village the same scheme sits in sections 198-A to 198-F of the Tamil Nadu Panchayats Act 1994.

  • The employer is whoever pays the salary. The Panchayats Act defines the employer as "the person or the officer who is responsible for disbursement of such salary" (s.198-A(b)). For a contract crew, that is the contractor that runs the payroll.
  • Deducted or not, the employer pays. The employer deducts the tax before paying the wage and is "irrespective of whether such deduction has been made or not" liable to pay it (Panchayats Act s.198-C; the urban equivalent is s.117-C).
  • Casual workers are excluded. Both Acts define the taxable person to exclude "any person employed on a casual basis" (Panchayats Act s.198-A(e); quoted in the Chennai notice). Neither defines casual [VERIFY: whether short-term contract labour counts as casual for this purpose].

The Chennai slabs, and what they mean for a contract crew

The tax is set on half-yearly income, and most full-time contract workers in Chennai land in the top slab. The Greater Chennai Corporation's notice R.D.(HQ).C.No.PT/SPL/2024 of 6 March 2025 sets these rates:

Half-yearly incomeAbout a monthTax each half-year
Up to ₹21,000Up to ₹3,500Nil
₹21,001 to ₹30,000₹3,500 to ₹5,000₹180
₹30,001 to ₹45,000₹5,000 to ₹7,500₹425
₹45,001 to ₹60,000₹7,500 to ₹10,000₹930
₹60,001 to ₹75,000₹10,000 to ₹12,500₹1,025
₹75,001 and aboveAbove ₹12,500₹1,250

A worker on ₹15,000 a month earns ₹90,000 in a half-year and pays ₹1,250, or ₹2,500 a year. That is the ceiling: Article 276(2) of the Constitution caps a profession tax at ₹2,500 a person a year [VERIFY: Article 276(2) text not opened this run]. The lower slabs matter mostly for part-time workers and for anyone who joins late in a half-year.

When it is deducted and paid

Twice a year, for April to September and October to March. Those are the half-years the Panchayats Act defines (s.198-A(c)), and the Chennai notice works on the same periods. In Chennai the Corporation's notice set the deadlines for the second half of 2024-25: deduct from salary by January, remit before 31 March. The first half's tax is due before 30 September, as the Corporation reminded employers in 2025 [VERIFY: the first-half due date in the Corporation's own notice; seen in press reports only].

  • Returns first, then payment. The Chennai notice makes the returns in Forms 14 and 15, filed on the Corporation's portal with the employee data template, mandatory before payment. In a village the return must carry proof of full payment or it is not treated as filed (s.198-D(2)).
  • Late payment costs interest. Unpaid tax carries interest of up to 1% a month for the whole period of default, at the rate prescribed (Panchayats Act s.198-F(2)). The urban provision is section 117-F [VERIFY: the prescribed rate under the 2023 urban rules].
  • A wrong return costs double. An incorrect or incomplete return draws a penalty equal to 100% of the shortfall (s.198-F(1)).

Outside Chennai: which body, and which rates

The tax goes to the local body where the work is done, and each body publishes its own rates. Another corporation, a municipality or a town panchayat levies it under the same Urban Local Bodies Act; a village panchayat levies it under section 198-B of the Panchayats Act, whose rates the panchayat publishes (s.198-B(3)). Many industrial sites around Chennai sit in panchayat areas, so the Chennai table above does not apply to them [VERIFY: the current rates of the panchayat where the site sits].

A worker pays once per half-year, wherever they work. If the tax has been paid for a half-year to any local authority in the State, a change of place does not make it payable again to another (Panchayats Act s.198-B(4)). For a contract worker who moves between sites or contractors mid-year, that is the rule that prevents a second deduction, provided the new employer asks for proof of the first.

What a site should check

The liability sits with the contractor, so the site's job is to see the evidence. The Panchayats Act chapter has no clause, like those for PF and ESI, that makes the principal employer answerable for a contractor's default [VERIFY: the same for Chapter VI-A of the urban Act], but an unpaid tax still surfaces as a grievance on the site's floor.

  1. The contractor's registration with the right local body, in Chennai its Profession Tax number, for the area where the site is.
  2. The deduction on the wage slip in the half-year's deduction month, at the slab that matches the worker's half-yearly earnings.
  3. The challan and the return for each half-year, kept with the site's monthly PF and ESI evidence.
  4. No double deduction for workers who joined from another employer mid-half-year and had already paid.

How Velura Services helps

We deduct Professional Tax for every worker we deploy in the half-year's deduction month, at the slab of the local body where they work, and file the return and challan that body requires. Both go into the site's evidence pack alongside PF and ESI, and a worker who joins mid-year is checked for tax already paid that half-year before anything is deducted again.

Frequently asked questions

Who deducts Professional Tax for contract workers in Tamil Nadu?

The contractor, because it is the employer that pays the wages. The Tamil Nadu Panchayats Act defines the employer as the person responsible for disbursing the salary, and the urban law follows the same scheme. That employer deducts the tax and is liable for it whether or not it made the deduction.

How much Professional Tax does a worker pay in Chennai?

It depends on half-yearly income. Under the Greater Chennai Corporation's notice of 6 March 2025, nothing is due up to ₹21,000 a half-year, and the tax then rises through ₹180, ₹425, ₹930 and ₹1,025 to ₹1,250 for anyone above ₹75,000. A full-time worker earning more than about ₹12,500 a month pays ₹1,250 each half-year.

When is Professional Tax paid in Tamil Nadu?

Twice a year, for the half-years April to September and October to March. In Chennai, the Corporation's notice for the second half of 2024-25 required deduction from salary by January and remittance before 31 March, with returns in Forms 14 and 15 filed on its portal before payment. The first half's tax is due before 30 September.

Does a worker who changes contractor pay Professional Tax twice?

No. Under section 198-B(4) of the Tamil Nadu Panchayats Act, tax paid for a half-year to any local authority in the State is not payable again because of a change of place or employer. The new employer should ask for proof of the earlier payment before deducting for the same half-year.
